सेवा अटी व अंतिम वापरकर्ता परवाना करार / सेवा की शर्तें और अंतिम उपयोगकर्ता लाइसेंस समझौता / Terms of Service and End User License Agreement
These Terms of Service and End User License Agreement ("Agreement") govern access to and use of CSC Pro, a Windows desktop SaaS product provided by Sonkawade Labs, a sole proprietorship. By installing, activating, accessing, or using CSC Pro, the user agrees to this Agreement.
1. परिभाषा / परिभाषाएं / Definitions
- "Software" means CSC Pro, including desktop application components, connected cloud services, updates, and related documentation.
- "User" means the CSC operator, centre, employee, or authorized representative using the Software.
- "Credits" means prepaid usage units purchased for application processing.
- "Applicant Data" means personal and document data entered, uploaded, scanned, processed, or transmitted through the Software.
2. परवाना मंजुरी / लाइसेंस प्रदान / License Grant
Subject to this Agreement and payment of applicable charges, Sonkawade Labs grants the user a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use CSC Pro on authorized Windows devices for internal CSC operations related to lawful Maharashtra government service workflows.
3. मालकी हक्क / स्वामित्व / Ownership
The Software is licensed, not sold. All intellectual property rights, title, goodwill, source materials, branding, workflows, and related service logic remain the exclusive property of Sonkawade Labs or its licensors.
4. वापराची परवानगी / उपयोग की अनुमति / Permitted Use
- Use the Software only for lawful assistance to applicants seeking eligible government services.
- Use only by authorized CSC personnel on approved devices.
- Use only in accordance with this Agreement, applicable portal rules, and Indian law.
5. प्रतिबंधित वापर / निषिद्ध उपयोग / Prohibited Use
- Reverse engineer, decompile, disassemble, tamper with, or bypass license, device-binding, or security controls, except where non-waivable law expressly permits it.
- Resell, rent, sublicense, distribute, host for third parties, or provide timesharing access without written authorization.
- Use the Software to submit fraudulent, misleading, unauthorized, or unlawful applications.
- Upload or process personal data without proper authority, notice, or consent.
- Attempt to clone activation, spoof hardware identity, or evade motherboard-based device locking.
- Interfere with service integrity, cloud endpoints, payment flows, notification channels, or other users.
6. खाते, प्रवेश आणि सुरक्षा / खाता, प्रवेश और सुरक्षा / Accounts, Access, and Security
- The user is responsible for maintaining the confidentiality of login credentials, workstation access, and local files.
- The Software may use device binding linked to motherboard ID to control authorized installation and misuse prevention.
- Sonkawade Labs may suspend or restrict access if misuse, suspicious activity, unpaid dues, or security risks are detected.
7. क्रेडिट मॉडेल आणि शुल्क / क्रेडिट मॉडल और शुल्क / Credits and Fees
- CSC Pro uses a prepaid credit model.
- Current commercial reference rate: ₹10 per application, unless changed by written or in-app notice.
- Credits must be purchased in advance through authorized payment methods, including Cashfree Payments where enabled.
- Credits are consumed when an application workflow is initiated, processed, reserved, or otherwise treated as billable according to the product logic in force at the time.
- Purchased credits are non-refundable except where required by law or expressly approved in writing.
8. पेमेंट्स / भुगतान / Payments
Payment processing may be handled by Cashfree Payments or other authorized partners. Sonkawade Labs does not store full payment card details. Users are responsible for ensuring that payment information, taxation details, and transaction authorizations are correct.
9. रद्द करणे आणि समाप्ती / रद्दीकरण और समाप्ति / Suspension and Termination
Sonkawade Labs may suspend, deactivate, or terminate access immediately for breach of this Agreement, fraudulent use, security compromise, legal risk, excessive abuse, payment failure, or unauthorized device activity.
Upon termination, the license ends immediately. The user must stop using the Software. Provisions relating to payments due, disclaimers, liability limits, privacy, data handling, ownership, and dispute resolution will survive termination.
10. डेटा आणि वापरकर्ता जबाबदारी / डेटा और उपयोगकर्ता जिम्मेदारी / Data and User Responsibility
- The user is responsible for the legality, accuracy, authenticity, and authority behind all Applicant Data entered into the Software.
- The user must ensure that applicants are properly informed and that necessary consents or authorizations are obtained.
- The user remains responsible for reviewing application outputs before final submission to any government portal.
11. व्हॉट्सअॅप आणि तृतीय पक्ष सेवा / व्हाट्सऐप और तृतीय पक्ष सेवाएं / WhatsApp and Third-Party Services
The Software may integrate with Meta Cloud API for notifications and with other third-party services such as payment, hosting, database, OCR, and messaging providers. These integrations may be delayed, restricted, or unavailable due to third-party rules, verification status, outages, template rejections, or policy changes.
12. अद्यतने / अपडेट / Updates
Sonkawade Labs may provide patches, updates, fixes, configuration changes, or remote service changes at any time to improve functionality, compliance, security, or compatibility. Some updates may be required for continued use.
13. हमी नाकारणे / वारंटी अस्वीकरण / Warranty Disclaimer
The Software is provided on an "as is" and "as available" basis to the maximum extent permitted by law. Sonkawade Labs does not warrant uninterrupted operation, error-free form submission, always-accurate OCR, guaranteed eligibility outcomes, guaranteed portal uptime, or guaranteed WhatsApp delivery.
14. जबाबदारीची मर्यादा / दायित्व की सीमा / Limitation of Liability
To the maximum extent permitted by law, Sonkawade Labs shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of business, loss of applicants, failed submissions, data loss, loss of goodwill, or downtime arising from use of or inability to use the Software.
To the extent liability cannot be excluded, the total aggregate liability of Sonkawade Labs for claims arising out of this Agreement shall not exceed the amount of fees actually paid by the user for the affected service in the three months preceding the event giving rise to the claim.
15. भरपाई / प्रतिपूर्ति / Indemnity
The user agrees to defend, indemnify, and hold harmless Sonkawade Labs from claims, losses, damages, penalties, costs, and expenses arising from misuse of the Software, unlawful data processing, inaccurate submissions, breach of this Agreement, or violation of law or third-party rights.
16. गोपनीयता / गोपनीयता / Privacy
Use of CSC Pro is also governed by the Privacy Policy and any in-app data notices. Where there is conflict, this Agreement and the Privacy Policy should be read harmoniously to the extent possible.
17. समर्थन / सहायता / Support
Support, maintenance response times, onboarding help, or issue resolution may be offered at the discretion of Sonkawade Labs or as separately agreed. Nothing in this Agreement guarantees a specific service-level commitment unless explicitly documented in writing.
18. करारातील बदल / समझौते में परिवर्तन / Changes to This Agreement
Sonkawade Labs may revise this Agreement from time to time. Updated terms become effective when posted or communicated with an updated effective date. Continued use after such date constitutes acceptance of the revised terms.
19. लागू कायदा आणि न्यायक्षेत्र / लागू कानून और अधिकार क्षेत्र / Governing Law and Jurisdiction
This Agreement is governed by the laws applicable in Maharashtra, India. Courts at Latur, Maharashtra shall have exclusive jurisdiction over disputes arising out of or related to this Agreement, subject to any non-waivable statutory rights.
